The rules set out in this Privacy and Personal Data Protection Policy complement the provisions on the protection and processing of personal data set out in the contracts that Customers/Users enter into with GCLUB, as well as the rules set out in the terms and conditions that govern the offer of the various products and services and that are duly published on the respective websites.

Your data is collected by G CLUB – 3 CODE, LDA. Tax ID (NIF) 504 464 361, hereinafter referred to as GCLUB.

GCLUB processes and stores personal data within the European Union (EU) and follows best practices in the field of security and protection of personal data, having taken the necessary technical and organisational measures to comply with the General Data Protection Regulation (Regulation (EU) 2016/679), which is a directly binding legislative act for natural and legal persons who, whether or not they are resident in the EU, process data of citizens of the European Union, and which aims to ensure that the processing of personal data is lawful, fair, transparent and limited to the authorised purposes.

The privacy statement is the responsibility of GCLUB, which is considered the data controller for the purposes of the GDPR, and will determine the purpose and the means of processing the personal data submitted and collected online.

What is personal data?

Personal data is any information, of any nature and regardless of its medium, including sound and image, relating to an identified or identifiable natural person.

An identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to a name, an identification number, location data, online identifiers or to one or more factors specific to their physical, physiological, genetic, mental, economic, cultural or social identity.

What does the processing of personal data consist of?

The processing of personal data consists of an operation or set of operations performed on personal data or sets of personal data, by automated means or not, namely collection, recording, organisation, structuring, storage, adaptation, retrieval, consultation, use, disclosure, dissemination, comparison, interconnection, restriction, erasure or destruction.

Our data protection policy ensures that data is:

  • Processed lawfully, fairly and in a transparent manner in relation to the data subject (“lawfulness, fairness and transparency”);
  • Collected for specified, explicit and legitimate purposes and not further processed in a manner that is incompatible with those purposes;
  • Adequate, relevant and limited to what is necessary in relation to the purposes for which they are processed;
  • Accurate and kept up to date where necessary; every reasonable step being taken to ensure that inaccurate data, having regard to the purposes for which they are processed, are erased or rectified without delay;
  • Kept in a form which permits identification of data subjects for no longer than is necessary for the purposes for which the data are processed;
  • Processed in a manner that ensures its security, including protection against unauthorised or unlawful processing and against accidental loss, destruction or damage, using appropriate technical or organisational measures;

Purposes of the Processing of Personal Data.

Ensuring, whenever necessary, the prior consent of the data subject, we will collect, among others, the following information:

  • identification data (such as name, place of birth or date of birth);
  • contact data (such as mobile phone or email);

In general, the personal data collected is based on, and is intended for, adapting the services to the needs and interests of the Member/User, namely for access to specific features of the services, content suggestions, local information services as well as information and marketing actions.

In addition, personal data may also be processed for the purposes of complying with legal obligations and for the investigation, detection and prosecution of serious crimes.

Special categories of data

The registration type chosen (for example, couple or single) may reveal information about the data subject's sex life, which is a special category of personal data. This data is only processed with your explicit consent, given in the registration form, and only for access control and for the communications described in this policy. You may withdraw your consent at any time, through info@gclub.pt, without affecting the lawfulness of the processing carried out up to that date.

Registration of couples and data of another person

When the registration includes a second person, the person registering declares that this person has been informed of this policy and has authorised the provision and processing of their data. The second person has the same rights as any data subject and may exercise them through info@gclub.pt.

Cookies

Our website does not use tracking or analytics cookies. It stores in your browser only two strictly necessary elements, which do not require consent: the confirmation that you are over 18 years old, for 30 days, and, if you log in as a member, a session cookie that keeps you authenticated for 7 days and is deleted when you log out. If other technologies come to be used, this policy will be updated and, where the law requires it, your consent will be requested.

Retention period:

The length of time for which personal data is stored and kept varies according to the purpose for which the information is processed.

Member data is kept while the registration is active and is deleted or anonymised after 2 years without any entry to the clubs (or, if there was never an entry, 2 years after registration), without prejudice to the retention of records required by law, such as those of a tax nature.

Messages sent through the contact form are kept only for as long as necessary to reply to them.

In fact, there are legal requirements that oblige data to be kept for a minimum period of time. Thus, and whenever there is no specific legal requirement, the data will be stored and kept only for the minimum period necessary to pursue the purposes that motivated its collection or its subsequent processing, under the terms defined by law.

Age of majority

By accepting this privacy policy you guarantee that you are over 18 years old.

Use of personal data

The processing of personal data is based on the consent given by the data subject. Access to personal data is strictly limited to the personnel of the data controllers and processors.

Sharing of personal data

GCLUB guarantees that it does not intend to transfer data to countries outside the scope of the General Data Protection Regulation and, if it does so, it will ask for your consent.

GCLUB has entered into an Agreement with its processors by which they undertake not to transfer data to third countries.

In certain situations, both GCLUB and its Processors may be required to disclose personal information in response to requests by supervisory authorities in order to meet the requirements of the GDPR.

Security of processing

GCLUB is committed to ensuring the security of the personal data made available to it, having approved and implemented strict rules in this matter. Compliance with these rules is an obligation of all those who legally have access to such data.

Bearing in mind the concern and commitment that GCLUB shows in the defence of personal data, various security measures, of a technical and organisational nature, have been adopted in order to protect the personal data made available to it against its dissemination, loss, misuse, alteration, unauthorised processing or access, as well as against any other form of unlawful processing.

In addition, the third parties that, within the scope of the provision of services, process the personal data of the Member / User on behalf of GCLUB, are bound, in writing, to implement appropriate technical and security measures that, at all times, meet the requirements set out in the legislation in force and ensure the defence of the rights of the data subject (namely, the protection of the privacy and personal data of Customers / Users).

Access, rectification or erasure of personal data

As a data subject, the Customer/User has the right to request access to the data concerning them, and to ask for it to be rectified and erased. They may also restrict the processing of the data, object to it and request the portability of the data.

You may do so directly or by written request addressed to the respective Data Controller, through the contacts provided for that purpose in this document.

You may also ask the Data Controller for clarification, through info@gclub.pt, or lodge a complaint with the CNPD (the Portuguese data protection authority) whenever you consider that your rights are being violated.

Right of access

The data subject has the right to obtain from GCLUB confirmation as to whether or not personal data concerning them is being processed and, where that is the case, access to their personal data and to the information provided for by law.

The data subject has the right to obtain from GCLUB, without undue delay, the rectification of inaccurate or incomplete personal data concerning them.

Right to erasure (“right to be forgotten”)

b) The data subject withdraws consent on which the processing is based (in cases where the processing is based on consent) and there is no other legal ground for the processing;

c) The data subject objects to the processing and there are no overriding legitimate grounds for the processing;

Right to restriction of processing

The data subject has the right to obtain from GCLUB restriction of processing where, in particular, one of the following applies:

a) The accuracy of the personal data is contested, for a period enabling GCLUB to verify its accuracy;

b) The processing is lawful and the data subject opposes the erasure of the personal data and requests the restriction of their use instead;

c) GCLUB no longer needs the personal data for the purposes of the processing, but they are required by the data subject for the establishment, exercise or defence of legal claims;

d) The data subject has objected to processing, pending verification of whether the legitimate grounds of the controller override those of the data subject.

Right to data portability

If the processing depends on the data subject's consent, and that consent was given by automated means, the data subject has the right to receive the personal data concerning them, which they provided to GCLUB, in a structured, commonly used and machine-readable format.

Right to object

Where data processing is carried out for 1) the purposes of the legitimate interests pursued by GCLUB; or 2) data processing is carried out for direct marketing purposes or 3) profiling, you may also, at any time, object to the processing of your personal data.

Marketing emails

The data controllers are permitted, after explicit consent, to send marketing emails to the users of the site. At any time the user may withdraw consent through the link provided for that purpose in each email sent.
